TERMS AND CONDITIONS

  1. Contractual Relationship

    Your access and use of the Services constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Babylon Resources Ltd. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede prior agreements or arrangements with you. Babylon Resources Ltd. may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion thereof, at any time for any reason.

  2. Restrictions

    You may not: (i) remove any copyright, trademark or other proprietary notices from any portion of the Services; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by Babylon Resources Ltd. ; (iii) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the Services; (v) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or (vi) attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks.

  3. Ownership

    The Services and all rights therein are and shall remain Babylon Resources Ltd. property. Neither these Terms nor your use of the Services convey or grant to you any rights: to use or reference in any manner Babylon Resources Ltd. company names, logos, product and service names, trademarks or service marks.

  4. Acceptance of general conditions

    The use of the services offered by this application implies acceptance by the user of these general terms and conditions. The user recognizes by the same fact to have taken full knowledge and renounce his own conditions. This acceptance will consist in the fact, for the user, to accept the present general conditions of use. The validation of the present general conditions will be deemed to have the same value as a signature on the part of the user. The user acknowledges the proof-of-value of the publisher's automated registration systems and, unless the contrary is proven, waives the right to challenge them in the event of a dispute.

  5. Use of Application

    You agree that you are responsible for your own communications, internet connectivity, internet fees and mobile data fees and for any consequences thereof. You agree that you will use the Application in compliance with all applicable local, state, national, and international laws, rules and regulations, including any privacy laws and laws relating to the export of data from your country of business. You agree that you will not use the Application to upload or distribute any content that infringes upon another party's intellectual property rights or other proprietary, contractual or fiduciary rights or obligations or is unlawful, defamatory, abusive, fraudulent, contains viruses, or is objectionable as may be reasonably determined by Babylon Resources Ltd. You agree that you will not authorize or encourage any third party to use the Application to upload or distribute any content that infringes upon another party's intellectual property rights or other proprietary, contractual or fiduciary rights or obligations or is unlawful, defamatory, abusive, fraudulent, contains viruses, or is objectionable as may be reasonably determined by Babylon Resources Ltd. You agree that you will not tamper with or encourage others to tamper with the GPS products or Application in order to affect the quality of collected data or prevent others from using the Application. You agree that you will keep safe your online username and password and will not disclose it to others.

  6. Required Materials

    The equipment required to use the publisher services is as follows: - A mobile phone operating with the Android operating system and having access to the 2G or 3G Internet network. - A computer with the following features: 1Ghz processor, 256MB of RAM, 1268 by 768 resolution. Internet browser required: Explorer 8 or 9, Firefox 4 or 5, Safari 5, Opera 10 or Google chrome and all subsequent versions. - High-speed Internet connection for both the mobile phone and the computer. We automatically collect certain information to help us understand how our users use the Services (which we will refer to in this Privacy Policy collectively as "Usage Data"). For example, each time you visit the Services, we may automatically collect your IP address, browser and computer type, access time, the Web page you came from, the URL you go to next, and the Web page(s) that you access during your visit. We will use such Usage Data to diagnose problems with our servers and software, to administer the Services, and to gather demographic information. The login credentials of the user are those entered during the installation of the application. By logging into the publisher's site, the user can access his user account and: -Locate your hardware; -Record, compile and display your location; and -Publish your location to third parties designated by you by means of location publication controls available within the applications (e.g., settings, user preferences). - Obtain the GPS position of the mobile phone, - Retrieve the list of contacts, - Retrieve the list of its Gmail messages, - Receive the list of calendar events, - See the list of photos taken, - Visualize the websites visited and block them, - Control the installed applications and block them, - Receive the GPS position every 30 seconds, - Receive notifications from the phone. In addition, the publisher reserves the right to collect the public IP address of all users. The collection of this IP address will be done anonymously, it will be kept for the same duration as the personal information and will be only to allow a good administration of the services proposed by the application. The IP address corresponds to a series of digits separated from points, allowing the unique identification of a terminal (computer, Smartphone etc.) on the Internet network.

  7. Disclaimer of liability of publisher

    In the event of inability to access the site, due to technical problems or of any nature not attributable to the publisher, the customer cannot claim any damage and cannot claim any compensation.

  1. Notwithstanding anything in this Privacy Policy to the contrary, we reserve the right, and you hereby expressly authorize us, to share any User Information:

  5. Our parent company, subsidiaries, joint ventures, or other companies under common control with us (in which case we will require such entities to honor this Privacy Policy); and

We also may allow certain analytic services and providers of applications used on the Services to collect Non-Personally Identifiable information by placing cookies on the Services that will track certain performance of our Services, such as, web traffic, click-through, etc., in order to assist us and our service providers in better understanding the interests of our users and to better serve those interests.
  2. Modification of the general conditions

    These general terms and conditions may be amended at any time by the Babylon Resources Ltd. or his agent. The general conditions applicable to the user are those in force on the day of its connection to the application. Babylon Resources Ltd of course undertakes to retain all its previous terms and conditions and to send them to any user who so requests. By installing the Application you ensure us that you go through the above Terms & Conditions, Privacy Policy and agree with them all.
